These Terms of Service ("Terms") govern your access to and use of the Zebra Organics website, email and mobile communications, and related services (collectively, the "Site" or "Services"). The Site and Services are operated by Zebra Organics, LLC, a division of Comfy House Foods, Inc. ("Zebra Organics," "we," "us," or "our").
By accessing or using our Site or Services, including by purchasing products or opting in to email or SMS communications, you agree to be bound by these Terms.
1. General Use of the Site
You may use our Site only for lawful purposes and in accordance with these Terms. You agree not to:

2. Accounts and Purchases
To make purchases or manage subscriptions, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
All purchases are subject to availability and confirmation of pricing at checkout. Payment processing is handled securely through BigCommerce and authorized third-party providers, including PayWhirl for recurring and subscription orders.
3. Auto-Ship and Subscription Terms (PayWhirl)
We offer subscription or "auto-ship" options for certain products.
By enrolling in a subscription, you authorize Zebra Organics and its payment processors to automatically charge your selected payment method on a recurring basis for each order cycle until you cancel.
You may cancel or modify your subscription at any time through your account settings or by contacting us at info@zebraorganics.com prior to your next billing date. Changes or cancellations made after an order is processed may not take effect until the next billing cycle.
4. Email Communications
By providing your email address at checkout, during account creation, or through a sign-up form, you consent to receive transactional and marketing emails from Zebra Organics.
You may opt out of marketing emails at any time by clicking the "Unsubscribe" link included in our emails or by contacting us directly. Transactional emails (such as order confirmations, shipping notifications, and account notices) are necessary to complete your transactions and cannot be opted out of.
5. Mobile Messaging Terms of Service (SMS) — TCPA & CTIA Compliant
A. Program Description
The Zebra Organics mobile message service (the "Service") provides transactional, informational, and promotional text messages, including order updates, shipping notifications, subscription reminders, review requests, cart reminders, promotions, and special offers.
The Service is operated by Zebra Organics, LLC, a division of Comfy House Foods, Inc.
B. Consent to Receive Messages
By providing your mobile phone number and opting in via our website, checkout, sign-up form, keyword, or other opt-in method, you expressly consent to receive recurring automated SMS/text messages from Zebra Organics at the number you provided, including messages sent using an automatic telephone dialing system (ATDS) or similar technology.
Your consent is not a condition of purchase, and participation in the Service is completely voluntary.
C. Message Frequency and Costs
Message frequency varies. Zebra Organics does not charge for SMS messages; however, message and data rates may apply, and you are responsible for any fees imposed by your wireless carrier. Please consult your mobile plan or carrier for details.
D. Opt-Out Instructions
You may opt out of the Service at any time by replying STOP to any message. You will receive a one-time confirmation message confirming your opt-out. After opting out, you will no longer receive SMS messages unless you re-enroll.
If you participate in multiple Zebra Organics SMS programs, you must opt out of each program separately unless otherwise required by law.

F. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
G. Number Changes and Accuracy
You agree to provide a valid mobile number and to update your information if your number changes. If you obtain a new mobile number, you must re-enroll in the Service with your new number. Messages sent to reassigned or changed numbers may not be received.
H. Changes to the SMS Program
We may modify, suspend, or terminate the Service, including changing any short code or telephone number used to operate the Service, at any time. Where required by law, we will provide notice of material changes. Messages sent to discontinued numbers or codes (including STOP or HELP requests) may not be received, and we are not responsible for honoring such requests.
I. Limitation of Liability (SMS)
To the fullest extent permitted by law, Zebra Organics is not liable for failed, delayed, misdirected, or undelivered messages; errors in message content; or any actions taken or not taken in reliance on SMS communications.
6. Product Reviews (Stamped)
We use Stamped to collect and display product reviews and other user-generated content. By submitting a review, you grant Zebra Organics and its service providers a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display your content in connection with our Site and marketing materials.
You represent that your submitted content is truthful, lawful, and does not infringe the rights of any third party.
7. Third-Party Services
Our Site integrates third-party services, including BigCommerce, PayWhirl, Klaviyo, Stamped, Google, Meta (Facebook/Instagram), and other analytics, advertising, fulfillment, and technology providers.
These third parties may process data in accordance with their own privacy policies. Zebra Organics is not responsible for the content, actions, or practices of third-party websites or services.
8. Intellectual Property
All content on the Site—including text, graphics, logos, images, product names, and software—is the property of Zebra Organics, LLC, Comfy House Foods, Inc., or their licensors and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works of Site content without our prior written consent.
9. Disclaimer of Warranties
The Site, Services, and all products are provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Zebra Organics, LLC and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, Services, or products.
Our total liability for any claim shall not exceed the amount you paid for the product(s) giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Zebra Organics, LLC, Comfy House Foods, Inc., and their officers, employees, and agents from any claims, damages, losses, or liabilities arising out of your use of the Site or Services, your violation of these Terms, or your infringement of any third-party rights.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction in such courts.
13. Privacy
Your use of the Site and Services is subject to our Privacy Policy, which describes how we collect, use, and protect personal information, including information collected through email and SMS communications. SMS opt-in data and consent are not sold or shared with third parties for their own marketing purposes.
14. Changes to These Terms
We may update these Terms from time to time by posting a revised version on this page with an updated Effective Date. Your continued use of the Site or Services after any changes constitutes acceptance of the revised Terms.
